The foreclosure files are available for public inspection Monday through Friday, from 8:00 a.m. to 5:00 p.m. in the Civil Division of the Martin County Clerk's Office, 100 East Ocean
Boulevard, 3rd Floor, Constitutional Office Building, Stuart, Florida.
This division has a clipboard containing copies of the Notice of Sales
from each case that has a foreclosure sale date scheduled. Copies of the
judgments and other documents may be obtained at $1.00 per page.

The Notice of Sale for each case is published in a newspaper
once a week for two consecutive weeks at least 5 days prior to the sale.
YOU MUST DO YOUR OWN RESEARCH. The order reflects
a legal description of the property being foreclosed.

THE CLERK'S OFFICE ASSUMES NO RESPONSIBILITY FOR ANY
ENCUMBRANCES (JUDGMENTS, MORTGAGES, TAXES AND OTHER LIENS) ON ANY PROPERTY
OFFERED FOR SALE. It is in your best interest to have a Title Search done by
an attorney or Title Company. However, you may search the Official Records
located in the Archives Division on the 1st floor of the Constitutional Office
Building.
Foreclosure sales are held on Tuesdays and Thursdays at 10:00
a.m. Designation of assigned courtroom will be posted between the Courthouse and the Constitutional Office Building.
Prospective bidders must register between 9:45 a.m. and 10:00 a.m. the morning of the sale.
The successful bidder is required to deposit 5% of their final bid, unless the judgment states otherwise. This deposit must be paid immediately following the sale and is a non- refundable deposit. The successful bidder may not leave the sale to get the deposit money that
is due. The balance of the bid, documentary stamp tax, Clerk's fee for holding the sale ($70.00) and the Registry of the Court fee (3% for the first $500, and 1.5% for each subsequent $100, of the total amount deposited) must be paid to the clerk by 10:00 a.m. the next business day unless the final judgment states otherwise.
ALL MONEY PAID MUST BE IN CASH OR CASHIERS CHECK DRAWN ON A UNITED STATES BANK ONLY.
CHECKS MUST BE MADE PAYABLE TO: CLERK OF COURTS. The successful bidder must pay the Documentary Stamp Tax prior to issuing title. The purchaser of the property will be issued a Certificate of Title. This title contains no warranties.
The Certificate of Title will be recorded in the Official Records on the eleventh day after the sale. If the tenth day is a non-business day, the next business day will be treated as the tenth day. This ten-day period is for objections to the sale. If objections are filed, the court will rule at a hearing as to whether or not a Certificate of Title is to be issued. If a bankruptcy is filed, the clerk is stayed from issuing a title or taking any action pending further order of the court.
It is possible you will have to take legal action to get
possession of the property. Until the Court grants possession, you may not have
immediate access to the property.
