Recording Division


Section 201.022, F.S., has been repealed effective June 1, 2008.
As a result of Chapter 2008-24, Laws of Florida, a Form DR-219
(Return for Transfers of Interest in Real Property) is no longer
required when filing a deed.

Please continue to include either of the following pieces of information with your deed:

2) Amount of Documentary Stamp Tax

The Clerk of the Circuit Court is also the County Recorder. The Clerk records instruments presented for recording, upon payment of the service charges, as prescribed by law. All instruments recorded in the Official Records are open to the public, under the supervision of the Clerk, for the purpose of inspection and copying.
The Recording/Indexing Department is located at the Martin County Courthouse, 3rd Floor, 100 East Ocean Blvd, Stuart, Florida 34994.

The Following Must be Paid in Addition to Recording Fees

DEEDS:

  • State Documentary Tax Stamps: Rate of $.70 per $100 of consideration or fraction thereof of Deed or other instrument conveying an interest in real estate. The State tax on deeds applies to the full consideration and the value of any mortgage may not be deducted in computing the consideration.

  • State Documentary Tax Stamps on Deeds, subject to mortgage being assumed, if no Assumption of Mortgage recorded: Rate of $.35 per $100 or fraction thereof on the balance of the mortgage.


MORTGAGES:

  • State Documentary Tax Stamps: Rate of $.35 per $100 or fraction thereof.

  • Intangible Tax: Rate of 2 mills on the dollar.

  • AGREEMENT & CONTRACT FOR DEED: (any pay that encumbers real estate)

  • State Documentary Stamps On full consideration Rate of $.70 per $100 or fraction thereof

  • State Documentary Tax Stamps: Rate of $.35 or $100 or fraction of thereof.

  • Intangible Tax: Rate of 2 mills on the dollar.


NOTICE OF COMMENCEMENT:

  • If you request a certified copy of the original recorded Notice of Commencement, the cost is $1.00 per page for the copy, plus $2.00 for certification of document.

Preparation of Instruments for Recording

  • The name of each person who executed instrument must be legibly printed , typewritten or stamped immediately below signature.

  • The name of each witness to the instrument must be legibly printed, typewritten or stamped immediately below signature. Signatures of two witnesses are required on a deed.

  • The name of the person who prepared the instrument must be included on the document.

  • Notary public seal, expiration date and commission number or corporate seal must be affixed, if applicable.

  • Include the grantee's mailing address if transfer of interest is in real estate. (Example: Deeds, Agreements and Contract for Deeds)

  • Corrective deeds must have a minimum of $.70 documentary stamps.

  • Re-recorded instruments must include a statement placed on the first page as to why it is being re-recorded.

  • Affix the name and address of person to whom the instrument is to be returned on the front of the instrument and provide us with a self address envelope.

  • 3X3 top right-hand corner as required by statute

  • No personal checks
